Initial Comments:


Based on the findings of an onsite unannounced relicensure survey completed, September 7, 2021, Sade Home Health Care Agency was found to be in compliance with the requirements of PA Code, Title 28, Health and Safety, Part IV, Health Facilities, Subpart A, Chapter 51.

Based on the findings of an onsite unannounced state relicensure survey completed, September 7, 2021, Sade Home Health Care Agency was found NOT to be in compliance with the following requirements of PA Code, Title 28, Health and Safety, Part IV, Health Facilities, Subpart H, Chapter 611, Home Care Agencies and Home Care Registries.

611.4(a) LICENSURE
Requirements for HCA and HCR

Name - Component - 00
A current copy of this Chapter shall be maintained at the home care agency or home care registry.

Observations:



Based on review of employee files, and interview with the administrator, it was determined that the agency failed to maintain a current copy of this Chapter at the home care agency or home care registry.

Findings include:

On September 7, 2021 at approximately 11:00 a.m., in an interview with the Administrator it was confirmed that a copy of Chapter 611 was not available at the agency.





Plan of Correction:

The Administrator will be responsible and will ensure that corrective measures are
taken and implemented by October 7, 2021.
Sade Home Healthcare Agency will conduct an in-service by October 7, 2021, with
all staff members on the Licensure requirements for HCA and HCR in accordance
with the requirements of § 611.4 (a).
The Human Resource Coordinator will ensure that the monthly audits of direct care
workers files are completed for three months and documented in the employee file.
The Agency will ensure that a copy of the steps to obtain HCA certification is
included in the new employee application file and measures will be put in place to
ensure that new employee complete the certification prior to employment or
immediately thereafter.


611.57(a) LICENSURE
Consumer Rights

Name - Component - 00
(a) The consumer of home care services provided by a home care agency or through a home care registry shall have the following rights: (1) To be involved in the service planning process and to receive services with reasonable accommodation of individual needs and preferences, except where the health and safety of the direct care worker is at risk. (2) To receive at least 10 calendar days advance written notice of the intent of the home care agency or home care registry to terminate services. Less than 10 days advance written notice may be provided in the event the consumer has failed to pay for services, despite notice, and the consumer is more than 14 days in arrears, or if the health and welfare of the direct care worker is at risk.

Observations:


Based on review of consumer files (CF), and interview with the administrator, it was determined that the agency failed to inform consumers on the right to receive at least 10 calendar days advance written notice of the intent of the home care agency or home care registry to terminate services for three (3), of three (3) consumer files reviewed. (CF # 1, 2, and 3).

Findings include:

A review of CR #1 on September 7, 2021, at approximately 11:15 a.m. revealed a start of care on December 1, 2021. There was no documented evidence that the consumer was provided an informational packet containing the right to receive at least 10 calendar days advance written notice of the intent of the home care agency or home care registry to terminate services.

A review of CR #2 on September 7, 2021, at approximately 11:30 a.m. revealed a start of care on January 23, 2020. There was no documented evidence that the consumer was provided an informational packet containing the right to receive at least 10 calendar days advance written notice of the intent of the home care agency or home care registry to terminate services.

A review of CR #3 on September 7, 2021, at approximately 11:45 a.m. revealed a start of care on March 18, 2019. There was no documented evidence that the consumer was provided an informational packet containing the right to receive at least 10 calendar days advance written notice of the intent of the home care agency or home care registry to terminate services.

On September 7, 2021, at approximately 3:00 p.m. it was confirmed in an exit interview that the consumers were not informed of the right to a 10 day notice.







Plan of Correction:

The Administrator will be responsible and will ensure that corrective measures are
taken and implemented by October 7, 2021.

Sade Home Healthcare Agency will conduct an in-service by October 7, 2021, with
all staff members on the Consumer Right in accordance with the requirements of §
611.57 (a).
The Administrator will ensure that the monthly audits of consumer files are completed for three months and until compliance. The Agency will ensure that a copy of the 10 days written notice is included in each consumer welcome package and signed by the
consumer/ consumer representative as well as Sade Home Healthcare Representative at the time of admission.

Based on the findings of an onsite unannounced relicensure survey completed, September 7, 2021, Sade Home Health Care Agency was found to be in compliance with the requirements of 35 P.S. 448.809 (b).
